The Mississippi Attorney General issued an official opinion on June 11, 2025, that clarified state law. The sale of products that are derived from cannabis and not FDA-approved, are illegal in Mississippi unless purchased in accordance with the Mississippi Medical Cannabis Act.
This means that products sold anywhere in Mississippi - gas stations, convenience stores, pharmacies, grocery stores - that are derived from the cannabis plant and not FDA-approved are now illegal to sell or possess with the intent to sell.
Marijuana and THC are on Mississippi's Schedule I controlled substances list including all parts of the cannabis plant including every compound, mixture, or derivative. This includes synthetic derivatives of THC with similar chemical structure and pharmacological activity.
Current law allows hemp to be commercially grown by licensed farmers as long as the THC content is .3% or less. The Attorney General clarified that "hemp" for cultivation purposes is separate from what is permissible to be sold for products that are ingested or consumed.
The Attorney General's official opinion states that all products derived from hemp or cannabis regardless of the THC level and designed for human ingestion or consumption must be FDA approved. Except for two drugs only available with a prescription, 100% of these products are not FDA approved.
