Mississippi Attorney General Clarifies Illegal Cannabis Products

Mississippi laws regarding cannabis, hemp, and marijuana are confusing and difficult to enforce. The official opinion by Attorney General Lynn Fitch on June 11, 2025, clarified that a substance is illegal to sell, or possess with intent to sell if it:


  • Contains any ingredients from the cannabis plant including THC and all derivatives including synthetics
  • Is not FDA approved - and none of these products are FDA approved


These are the only two requirements for the products to be classified as Schedule 1 drugs in Mississippi making them illegal to sell or possess with the intent to sell.


Illegal products are now much easier for law enforcement to identify.

Product Testing No Longer Needed

This also clarified that the 0.3% THC limit only applies to the commercial cultivation of hemp (a type of cannabis plant) for industrial uses, and this has no bearing at all on whether or not the product is legal to sell for human consumption.


Because of this clarification, product testing is no longer needed for the law to be enforceable. 

Does Not Affect Kratom

The Attorney General official opinion is limited to these products and do not include other similar products like kratom, which is not derived from the cannabis plant.
